1. Agreement to these terms

By accessing gritobay.com or placing an order, you agree to these Terms of Service, our Privacy Policy, and our Return & Refund Policy. If you do not agree, do not use the store or place an order. You must be legally capable of entering a binding contract in your location or use the store with permission from a parent or legal guardian.

2. Store use

You may use the store only for lawful personal or commercial purchasing activity. You must not interfere with store security, introduce malicious code, scrape or copy the store in a way that violates law or our rights, impersonate another person, submit false information, or use the store for fraud or abuse.

3. Products and size information

We aim to describe and display products accurately. Screen settings, photography, lighting, print placement, and manufacturing may cause reasonable differences in color or appearance. Product availability may change without notice.

Size-chart measurements are garment measurements. Before purchasing, you must compare them with a garment you own and choose your size carefully. You are responsible for the size you select. Fit or sizing preference is not a basis for return, refund, or exchange, as explained in our Return & Refund Policy.

4. Pricing, promotions, and payment

Prices are displayed in the currency shown at checkout and may change before an order is placed. Taxes, shipping, duties, and other charges may be added where applicable. Promotions, bundles, and discount codes are subject to their stated conditions and may be changed or ended where legally permitted.

Payment must be authorized by the payment provider. We may correct genuine pricing or listing errors and, where necessary, cancel and refund an affected order in accordance with applicable law.

5. Orders and acceptance

An order confirmation acknowledges that we received your order; it does not necessarily mean we accepted it. We may refuse or cancel an order for legitimate reasons, including suspected fraud, payment failure, inventory error, pricing error, legal restrictions, or inability to deliver. If we cancel after payment, we will issue the required refund.

6. Orders and fulfillment

All items are in stock and ship within 10 days. Any shipping date shown is an estimate, not a guarantee. Delays may occur because of inventory, carrier, customs, or events outside our reasonable control. We will provide material updates where required and honor cancellation or refund rights that cannot legally be excluded.

7. Shipping and delivery

Shipping estimates begin when an order is ready to leave fulfillment, not necessarily when it is placed. Carrier delays and customs processing are outside our direct control. Risk of loss and title pass as provided by applicable law. Customers are responsible for accurate delivery information and for duties or import charges unless checkout states otherwise.

8. Returns, refunds, and cancellations

All sales are final for change of mind, preference, fit, and customer-selected sizing. The full conditions, eligible order problems, and remedies are stated in our Return & Refund Policy, which forms part of these Terms. Nothing in these Terms excludes rights that cannot lawfully be waived.

9. Intellectual property

The store and its content — including the Grito Bay name, logos, graphics, artwork, product designs, photographs, text, and layout — are owned by or licensed to Grito Bay and are protected by applicable intellectual-property laws. No rights are granted except the limited right to use the store for its intended purpose. You may not reproduce, modify, distribute, sell, or exploit store content without prior written permission or another lawful basis.

10. Reviews and customer content

If you submit a review, image, comment, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, and not misleading or infringing. You grant Grito Bay a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and use that content for operating and promoting the store, subject to applicable law and our Privacy Policy. We may moderate or remove content where legally permitted.

11. Third-party services and links

The store may rely on or link to third-party services, including Shopify, payment processors, carriers, social platforms, and analytics tools. Their services are governed by their own terms and privacy practices. Grito Bay is not responsible for third-party content or services except to the extent required by law.

12. Disclaimers

To the fullest extent permitted by law, the store is provided on an "as available" basis. We do not promise uninterrupted or error-free access. Product and service warranties are limited to those expressly stated and to warranties that cannot legally be excluded.

13. Limitation of liability

To the fullest extent permitted by law, Grito Bay will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the store or products. Where liability cannot be excluded, it is limited only to the extent permitted by law. These limitations do not apply where prohibited, including to liability that cannot legally be limited.

14. Indemnification

To the extent permitted by law, you agree to indemnify Grito Bay against third-party claims, losses, and reasonable costs caused by your unlawful misuse of the store, your violation of these Terms, or content you submit that infringes another person's rights.

15. Governing law and disputes

These Terms are governed by the laws that apply to Grito Bay's business and the transaction, without depriving consumers of mandatory protections available in their place of residence. Before filing a claim, please contact support@grito-bay.com so we can try to resolve the issue informally. Nothing in this section prevents either party from using a court, regulator, or dispute process available under applicable law.

16. Changes, severability, and entire agreement

We may update these Terms by publishing a revised version with a new effective date. Changes do not retroactively alter completed purchases unless permitted by law. If any provision is unenforceable, the remaining provisions continue in effect. These Terms and the policies they incorporate form the agreement governing store use and purchases.
